1. Agreement and incorporated policies
By using FundRiseMe, you agree to these Terms and the Acceptable Use Policy, Community Guidelines, Privacy Notice, Cookie Policy, Refund and Donation Review Policy, and any campaign-, country-, payment-, or feature-specific terms shown to you. If you do not agree, do not use the service.
2. Who may use FundRiseMe
You must have legal capacity to enter a binding agreement and meet the minimum age and other eligibility requirements where you live. A person creating a fundraiser for someone else must have a genuine relationship to the beneficiary and appropriate authority or consent. Organizations must act through an authorized representative.
3. Accounts and security
Provide accurate, current information; maintain one appropriate account unless additional accounts are authorized; protect credentials and devices; and notify contact@fundriseme.com promptly of suspected compromise. You are responsible for activity performed through your account unless applicable law provides otherwise.
4. Fundraiser creation and review
Fundraiser titles, stories, images, goals, beneficiaries, locations, payout details, and updates must be truthful, complete, and not materially misleading. Submission does not guarantee publication. We may request identity, beneficiary, organization, relationship, expense, event, medical, charitable, or payout information and may decline or delay publication.
5. Organizer and team responsibilities
Organizers control campaign content and are responsible for obtaining consent from people named, pictured, or described; explaining who receives funds and how they will be used; keeping payout details accurate; publishing material changes; responding to reasonable questions; complying with laws, taxes, permits, and professional obligations; and using funds consistently with the published purpose.
6. Donations and donor decisions
A donation is a voluntary payment made in support of a fundraiser and ordinarily is not a purchase, investment, loan, equity interest, or guarantee of a result. Donors are responsible for reviewing the campaign and deciding whether to donate. FundRiseMe does not guarantee the truth of every statement, the success of a fundraiser, or the organizer’s conduct.
7. Payment processing and authorization
Payments and payouts may be processed by third-party providers. By initiating a transaction, you authorize applicable charges, currency conversion, provider fees, fraud checks, and legally required information sharing. Provider terms also apply. Transactions may be declined, delayed, reversed, held, or reviewed for security, compliance, dispute, chargeback, sanctions, or verification reasons.
8. Fees, tips, taxes, and receipts
Any platform fee, payment-processing fee, currency conversion, optional tip, or other charge will be disclosed where applicable. Organizers and donors are responsible for determining tax consequences and whether a donation is tax-deductible. A payment receipt is not a charitable tax receipt unless expressly issued by an eligible organization under applicable law.
9. Payouts and beneficiaries
Payout availability depends on supported countries, providers, verification, banking or PayPal availability, dispute status, and legal requirements. FundRiseMe may place holds, request documents, change payout instructions only after verification, return funds, or prevent payout where risk or law requires. The organizer is responsible for providing accurate beneficiary and payout information.
10. Updates and changed circumstances
Organizers must publish a clear update when the beneficiary, use of funds, expected costs, event, treatment, project, relationship, payout recipient, or other material circumstance changes. A changed goal must not conceal a material change. Supporters should be told if funds cannot be used as originally described.
11. Content licence and ownership
You retain ownership of content you submit. You grant FundRiseMe a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, communicate, distribute, and use that content as reasonably necessary to operate, secure, review, promote, and improve the service and the fundraiser. You represent that you have the rights and permissions needed to grant this licence.
12. Prohibited activity
You may not use FundRiseMe for fraud, fabricated beneficiaries, impersonation, unauthorized stories, deceptive donation activity, illegal goods or services, money laundering, sanctions evasion, bribery, trafficking, terrorism, violence, exploitation, child endangerment, hate, threats, harassment, doxxing, malicious software, intellectual-property infringement, privacy violations, spam, scraping, account sales, security interference, or evasion of enforcement.
13. Reports, investigations, and moderation
Anyone may report a fundraiser through the reporting tool. We may review content, account and payment signals, documents, public information, communications with involved parties, and provider alerts. We may ask questions, require corrections, restrict discovery, pause donations or payouts, remove content, preserve information, issue eligible refunds, suspend accounts, or notify providers or authorities.
14. Refunds, disputes, and chargebacks
Donations are generally final, subject to the Refund and Donation Review Policy, payment-provider rules, and applicable law. Contact FundRiseMe before filing a payment dispute where practical. Fraudulent or abusive disputes, repeated payment reversals, or attempts to obtain both a refund and chargeback may lead to account restrictions.
15. Third-party services and links
FundRiseMe may link to or integrate with payment, identity, email, analytics, hosting, social, mapping, or other third-party services. Those services are controlled by their providers and may have separate terms and privacy notices. FundRiseMe is not responsible for third-party content or availability except where law says otherwise.
16. Suspension and termination
You may stop using the service at any time. We may limit, suspend, or terminate access where reasonably necessary for safety, fraud prevention, legal compliance, provider requirements, non-payment, repeated complaints, policy breaches, or risk to users or the service. Certain provisions survive termination, including payment, licence, record-retention, dispute, liability, and enforcement terms.
17. Service availability and changes
Features may change, be withdrawn, or vary by country, device, account, campaign, or provider. Maintenance, failures, attacks, legal restrictions, or third-party outages may interrupt service. We do not promise uninterrupted, error-free, or permanently available service.
18. Disclaimers
To the maximum extent permitted by law, FundRiseMe is provided on an “as is” and “as available” basis. FundRiseMe is a technology platform and is not the organizer, beneficiary, charity, medical provider, financial adviser, tax adviser, insurer, escrow agent, trustee, or guarantor of a campaign unless expressly stated.
19. Liability
Nothing excludes liability that cannot lawfully be excluded. Otherwise, to the maximum extent permitted by law, FundRiseMe is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss; lost profits, data, goodwill, opportunity, or expected donations; organizer or donor conduct; third-party services; or events outside reasonable control. Any enforceable aggregate cap must be completed based on the operator’s jurisdiction before commercial launch.
20. Indemnity
Where legally permitted, you agree to defend and indemnify FundRiseMe against claims, losses, and reasonable costs arising from your fundraiser, content, misuse of funds, violation of law, breach of these Terms, or infringement of another person’s rights, except to the extent caused by FundRiseMe’s own unlawful conduct.
21. Governing law and disputes
The governing law, courts, consumer dispute process, arbitration terms, and any class-action waiver must be adapted to the legal entity and markets operating FundRiseMe. Mandatory consumer rights and local jurisdiction rules remain unaffected. These details must be finalized by qualified counsel before commercial launch.
22. Changes to these Terms
We may update these Terms to reflect new features, law, risk, provider requirements, or business changes. Material changes will be communicated where required. Continued use after the effective date constitutes acceptance where permitted; otherwise, consent will be requested.
